Get Fit Get Right Privacy Policy
This Privacy Policy applies to the access and use of the Get Fit Get Right website, which is a website with an online community and any successor sites thereof. The Starlight Starbright Children's Foundation (formerly known as The STARBRIGHT Foundation), a California non-profit public benefit corporation (“Starlight Starbright,” “we,” “us”), provides Get Fit Get Right and all site-related services (collectively, the “Site or “Get Fit”) to authorized users.
REGISTRATION AND PARENTAL CONSENT
This Site is intended for use by kids ages 13 to 18 (“users”) and is intended to provide educational information about fitness and diet. In order for users to enjoy all of the information and services Get Fit provides, users have the option to register for our online community. The registration process begins when the user is asked to provide his or her name, address, phone number, email address and date of birth. If the user gives a date of birth indicating that he/she is under the age of 13, Starlight Starbright will ask for the email address of a parent or guardian. The parent of guardian will be sent an email and asked to complete the child’s registration process by providing Starlight Starbright with a signed consent form. Users under the age of 13 only will be allowed to use the Site for a period of ten (10) days unless and until unless the parent/guardian provides consent.
The parent or guardian of a user under the age of 18 may ask us to review the personally identifiable information (defined below) that Starlight Starbright may have collected and maintained about that user, request the deletion of the user’s personally identifiable information, and/or refuse to permit our further collection and use of the user’s personal information. Parents or guardians may conduct such review, or may update contact and registration information, by contacting Starlight Starbright by mail or email subject to Starlight’s Starbright’s verification of identity. Starlight Starbright will only disclose personally identifiable information in response to a parent’s or guardian’s request after verifying that the individual submitting the request is the child’s parent.
THE INFORMATION STARLIGHT STARBRIGHT COLLECTS
Non-Personally Identifiable Information
Starlight Starbright collects some information about its users which is not personally identifiable to such users and which helps us improve the design and content of the Site and make the Site more interesting and useful to users. For example, we collect information on the number and frequency of users and visits to particular areas on the Site and the number and frequency of users who participate in an activity, contest or game. We only use such information in the aggregate and do not combine this non-personally identifiable information with personally identifiable information described below.
Health Related Information
As part of the Interactive Coach Tool, users are asked to provide the following: age, gender, height, weight, and information regarding diet, exercise or activity levels, and location. We use such health-related information only in connection with interactive educational tools or features available online.
Personally Identifiable Information
Starlight Starbright also collects the following personally identifiable information about its users at the time such users register to use the Site: (a) the user's name, date of birth and gender, (b) the name, address, phone numbers and email address of the user, and (c) if the user is under 13 years of age, the name, address, phone numbers and email address of the user’s parent or guardian. At the end of the registration process, the user is given a screen name (which for some users also functions as an email account) and password. To enable users to participate in some of our online activities and features, Starlight Starbright may ask them to send Starlight Starbright an email message or fill out an online form which may include personally identifiable information. Any such information collected by us, including the email address provided by the user, will be used for purposes relating only to such online activities and features. Also, users may submit, upload, reveal or otherwise provide certain information, images, text and pictures through their use of the Site, and participation in online activities, games, contests or in chat rooms, blogs and discussion areas (including health related information). Any such information collected by us will be used for purposes relating only to the Site.
HOW STARLIGHT STARBRIGHT USES THE INFORMATION IT COLLECTS
Starlight Starbright uses users’ personally identifiable information for promoting the Site as well as for our internal purposes, such as: (1) to enable users to subscribe to our online and email newsletter, (2) to express their opinions on various topics, (3) to provide feedback and comments about various features of the Sites, (4) to send instant messages and to chat with other Get Fit users, (5) to register for games or promotional events, (6) to introduce users to new features, areas or content of the Site, and (7) for other internal purposes.
Starlight Starbright, sometimes with the help of a third party, uses the non-personally identifiable information that it collects in the aggregate (e.g., 44% of the users are male) to improve the design and content of Get Fit and to enable Starlight Starbright to enhance the Get Fit experience. Starlight Starbright also may use this information in the aggregate to analyze Get Fit usage. Any such third party does not retain, share, store or use this information for any other purpose.
Starlight Starbright uses health-related information solely as part of its interactive online tools or programs designed to educate users about fitness and obesity.
Unless Starlight Starbright obtains the consent of the user (or the user’s parent or guardian, if applicable), Starlight Starbright will not voluntarily disclose the personally identifiable information of users to third parties except as necessary to provide or improve the Site and its services. Specifically, personally identifiable information may be disclosed: (1) to third party service providers who help operate, maintain, and support the site; (2) to third party contractors for the purpose of assisting with a contest or sweepstakes or arranging for the mailing of prizes. Starlight Starbright requires such service providers or contractors to hold users’ personally identifiable information in confidence, and to use and retain such information only for the purpose of operating and supporting the Site. In addition, Starlight Starbright may also disclose personally identifiable information if it is required to do so by law (for example, in response to a court order or a subpoena), in response to a law enforcement agency's request, or if it is necessary to enforce the Get Fit Terms of Use or in special cases where there is a threat to users or to protect the safety and security of users of the Site. Please note, however, that we are not responsible for and do not control any third party use of any information (including personally identifiable information) posted, uploaded or otherwise disclosed by users on the message boards, chat rooms, blogs, activities, games and other communication forums found on the Site which are accessible by other users of the Site. (Please see the section entitled “Display of User Information on Get Fit.”)
DISPLAY OF USER INFORMATION ON GET FIT
Starlight Starbright does not disclose the last name of users on the Site but keeps such information for administrative purposes only. However, in some instances the screen name, age and gender, along with a textual or image submission or audio or video content, of a user may be posted on or transmitted through the Site in connection with a game, contest, communications feature, or other feature of the Site. For example, if a user wins a picture drawing contest for a picture submitted to the Site, the picture and the user's screen name, age, and gender may be posted on the Site. Additionally, information, text and images posted or disclosed by the user on chat rooms, blogs, message boards, communications and other features of the Site (including, for example, the Get Fit Community bulletin board and blog) may reveal personally identifiable information and health-related information about the user. Starlight Starbright does not have the obligation to monitor such postings but has the right to alter or remove such postings, as described in the Terms of Use.

Get Fit may contain direct links to other Internet sites. However, please be aware that Starlight Starbright does not control and is not responsible for the content, privacy practices and other terms and conditions governing the use of such other Internet sites or any other Internet sites which are linked to such sites. Starlight Starbright encourages parents and guardians to become informed of the privacy practices and other terms and conditions of all such other Internet sites. This Privacy Policy applies solely to information collected by Starlight Starbright in relation to the use of Get Fit.
